Yes it is. Auto Motor und Sport interviewed Charlie Whiting and asked the same question. He said that the whale nose was possible if the crash structure was by the rules. But I doubt it will be a solution as Teams want to get as much air as possible under the car and not above.

The rules are generally about making aero less effective, so perhaps the problem with the old noses is not that they need people like Newey to make them work, but rather that this rule is what it takes to slow Newey down.
